BANGALORE: The High Court on Wednesday directed the State Government to relieve service doctors who have been selected for higher studies.A single bench headed by Justice Mohan Shantanagowdar, hearing a petition filed by Dr Anil Kumar, who had moved the High Court seeking directions to make a six-year service mandatory to take up Post Graduate courses has directed to vacate the stay. The stay was granted by Justice K Bhaktavatsala earlier this month directing not to relieve the doctors from service.Justice Mohan Shantanagowdar, in his interim directions, stated that the doctors can be relieved from the service to join the courses, but it is subjected to the result of the writ petition.He observed,  “Since the six year service rule does not apply to the candidates other than the year 2006-07, the conditions cannot be imposed on them.” The petitioner had challenged the new list of candidates released by the government for PG courses stating that there are several irregularities in the selection list dated September 8 and 9 and sought directions against the same. In his submission, he had stated that though the rules make six years of service mandatory, the selected list has several lapses with candidates who have not fulfilled the conditions also being selected.However, the respondents submitted that the order does not apply to the candidates other than candidates who have taken admission in the year 2006-07.
