HYDERABAD: The resignations submitted by Telangana legislators are still valid as their rejection by the Assembly speaker is unconstitutional, MLA and suspended TDP leader Nagam Janardhan Reddy has said.Speaking to reporters here on Monday, Nagam, citing Article 190(3)(B) of the Constitution, said that there was no discretionary power conferred on the speaker to reject the resignations of MLAs if a member informed him that he submitted his resignation voluntarily.“We have informed the speaker that we have submitted our resignations voluntarily.”Nagam said that rejecting the resignations with just a press note was invalid. “The Speaker should call all the MLAs individually and enquire with them.” Only the Assembly secretary can issue a bulletin with regard to the notifications issued by the speaker. “The Assembly secretary is not a PA to the speaker and cannot issue a single press note rejecting the resignations of all the MLAs. In our case, the speaker has no other option than accepting our resignations.” Citing the Vikram Singh vs Shri Ram Ballabhji Kasat And others case, Nagam said the speaker should accept their voluntary resignations.Notwithstanding his argument, Nagam and his three supporting Telugu Desam MLAs submitted their resignations afresh in separate letters on Monday.“As we thought that taking legal help will take much time, we resubmitted our resignations today,” hesaid.
