Mumbai: In a relief to those who lose sleep during Diwali, the Bombay High Court ordered on Thursday that no noise-making crackers can be burst after 2200 hours, IST.
The division bench of Justices H L Gokhale and J P Deodhar, in response to a PIL filed by Gaurang Vora, had earlier directed police to enforce noise pollution control rules during Navaratri.
The petitioner sought similar directives for Diwali as well as a ban on crackers similar to the order barring the use of loudspeakers after ten in the night.
Assistant government pleader Niranjan Pandit pleaded that according to the Supreme Court's rules, government could relax the 220o hours limit for loudspeakers for a total of 15 days a year.
Accordingly, Government allows the relaxation during festivals. The same relaxation can be allowed in the case of crackers on two days of Diwali, Lakshmi Pujan and Dhan Trayodashi, Pandit argued.
However, the court refused to grant the concession, saying that a relaxation cannot be granted for noise-making crackers even during Diwali.
This restriction does not apply to non-noise making crackers, the court clarified.
