'Not Charity': SC Underlines Homemakers' Financial Rights, Says 'Joint Bank Accounts, ATMs Are Necessity'

Underlining the significance of the role of homemakers in family building, the Supreme Court on Wednesday rooted for the financial rights of housewives and said access to a joint bank account and ATM card should be ensured to them.

According to an NDTV report, the apex court stressed the need for practical measures to ensure financial stability for women.

The said observation was made by a bench of Justice BV Nagarathna and Justice Augustine George Masih as the top court ruled that a Muslim woman can seek maintenance from her husband under Section 125 of the CrPC.

The court addressed a petition from a man challenging the Telangana High Court order that refused to interfere with the maintenance order.

In its observation, the bench highlighted the necessity for husbands to provide financial support to their wives through certain practical measures like maintaining joint bank accounts and sharing ATM access.

Furthermore, the apex court ruled that a Muslim woman can seek maintenance from her husband under Section 125 of the CrPC.

The court also noted that the ‘religion-neutral’ provision to all married women to empower them financially applies to all women irrespective of their religion.

The court stressed that the Muslim Women (Protection of Rights on Divorce) Act, 1986 will not prevail over the secular law.

“This right transcends religious boundaries, reinforcing the principle of gender equality and financial security for all married women,” the publication quoted the bench as saying.

The bench of Justices B V Nagarathna and Augustine George Masih also stated that maintenance is not charity but the right of all married women.
