CHENNAI: The Madras High Court has directed the police to register a case for offences under the Prevention of Corruption Act (PCA) against former DMK minister K Ponmudy and Shanthi, secretary of Thanthai Periyar Transport Corporation Employees Housing Building Co-operative Society in Villupuram. Justice T Sudanthiram, who gave the direction on Thursday, also refused bail to the duo.Holding that prima facie, it appears that Ponmudy had abused his official position as minister for the benefit of a trust called ‘Siga Educational Trust’ and thereby caused heavy loss and damage to the residents and members of the society, the jude gave the direction.The jduge was dismissing the bail applications from the duo, arrested for offences under various sections of the IPC including 120-B (criminal conspiracy) on August 31 last. The charge against them was that they had forged documents and obtained a sale deed for a land measuring 61,600 sq ft belonging to society in favour of the trust in July 2007.The judge observed that prima facie materials were available to show that the accused had deliberately planned and precisely got executed the sale deed. There had been several violations for the said transaction. The investigation was at the crucial stage. Further more, though the case was registered only under the provisions of the IPC, this court was of the view that the case should be registered for the offences under the PC Act also, the judge said, and gave the direction.
