New Delhi: The Supreme Court will pronounce on Monday its judgement on the PIL challenging the appointment of a Special Judge to try disproportionate assets case against RJD Chief Lalu Prasad and his wife Rabri Devi.
A Bench comprising Justice K G Balakrishnan, Justice A R Lakshmanan and Justice S H Kapadia will deliver its verdict on the PIL filed by senior BJP leader Sushil Kumar Modi and JD(U) leader Rajeev Ranjan Singh Lallan, in which they have challenged the quashing of income tax cases against the Railway Minister and his wife.
Besides, they have sought cancellation of their bail, contending that they have not adhered to the conditions imposed by the apex court.
In the PIL, the NDA leaders have questioned the appointment of Additional District Judge Munni Lal Paswan as Special CBI Judge to try the disproportionate assets case, an offshoot of the fodder case involving Prasad and Rabri Devi.
Senior advocate Ram Jethmalani, appearing for Prasad and his wife, had contended that the PIL was not maintainable as it was politically motivated, and if the appointment of Paswan as Special Judge to try the case was quashed it would set a wrong precedent as aspersions would be cast on the judge in all sensitive cases.
Defending the proceeding before the Income Tax tribunal and a change of prosecutor to hold the trial of the case, Solicitor General G E Vahanvati had said it was a false allegation that favours were shown to Prasad after the UPA government came to power at the Centre in May 2004.
