'Sufficient Proof': Delhi Court Orders Framing of Charges Against Jagdish Tytler In 1984 Anti-Sikh Riots Case

Delhi’s Rouse Avenue Court on Friday directed the Central Bureau of Investigation (CBI) to frame charges against Congress leader Jagdish Tytler in the 1984 anti sikh riots case.

Special CBI judge Rakesh Siyal said there was sufficient evidence against him to put him on trial. “Sufficient ground is there to proceed against the accused person,” the judge stated.

The court found that the trial against Tytler, a former Union Minister, could proceed under sections 143, 147 153A, 188, 295, 436, 451, 380, 149, 302 and 109 of the Indian Penal Code (IPC).

In January 2024, the CBI had claimed before a Delhi court that eyewitnesses saw Jagdish Tytler incite a mob during the 1984 anti-Sikh riots which led to the killing of three people in the Pul Bangash area of the national capital.

The probe agency had urged the court to frame charges against Tytler in the case.

In its charge sheet filed in May 2023, the CBI, citing an eyewitness, had accused Tytler of “inciting, instigating and provoking the mob” which had assembled near the Pul Bangash gurdwara on November 1, 1984.

Tytler was granted bail in the case by a sessions court in August last year on a personal bond of Rs 1 lakh and surety of the like amount under conditions that he will not tamper with the evidence in the case or leave the country without the court’s permission.

Three people were killed and a gurdwara was set ablaze in Pul Bangash on November 1, 1984, a day after the then-prime minister Indira Gandhi was assassinated by her Sikh bodyguards.

  • SAD MP from Bhatinda, Harsimrat Kaur Badal said the law “finally caught up with the butcher of Delhi”.

“This has become possible due to the tireless efforts of the Sikh community and Shiromani Akali Dal (SAD) which pursued the matter relentlessly and even prevailed upon the CBI to reopen the case against the Congress leader,” Badal wrote in an X post.

  • BJP national secretary Manjinder Singh Sirsa also took to microblogging site X and shared a video message welcoming the Delhi court’s order saying, “Finally, the wheels of Justice are moving”.

“Finally, the wheels of Justice are moving. I wholeheartedly welcome Rouse Avenue Court framing charges against Congress senior leader Jagdish Tytler in connection with the 1984 Delhi massacre. For 40 years, CBI alleged Tytler was cocooned by the Congress high command denying justice to innocent Sikhs killed. Tytler stands accused of saying “not enough Sikhs killed”.I thank PM @narendramodiJi, HM @AmitShah Ji and NDA Govt for honouring our demand of re opening the case against Tytler,” the BJP leader said.
