New Delhi: An Environment and Forest Ministry electrician who sent 'obscene and obnoxious' SMSes to a woman officer in his office has been sentenced to two years imprisonment by a Delhi court.
The convict, sacked by the ministry soon after a departmental inquiry held him guilty, showed no signs of remorse during the trial and allegedly wrote objectionable letters from jail to the complainant, serving as Officer on Special Duty (OSD) in the ministry.
"There is no doubt that the accused has been harassing her. He has been sending SMSes to her," Metropolitan Magistrate Sanjay Bansal said, sending electrician Basu Dev Mandal to jail for two years.
Expressing anguish over the confession of the convict that he did send those SMSes to his senior, the court said: "Conduct of the accused cannot be tolerated."
"The accused had admitted that he was insulting the modesty of complainant by sending obnoxious SMSes to her. From his answers, the misdemeanour was quite evident," it said.
The court, while convicting Mandal under section 506 (criminal intimidation) and 509 (insulting a woman's modesty) of the IPC, refused to release the convict on probation on the ground that he was a first-time offender.
"The convict is not ready to mend his ways. It has been informed he has been sending objectionable letters to the complainant even from the jail and an FIR has been lodged in that case as well," it noted.
The complainant had lodged a complaint with Tilak Marg police station on July 4 alleging that Mandal had been sending 'indecent and threatening SMSes' on her mobile phone.
