Sonia, Rahul not to appear in National Herald case, SC expunges HC observation
The apex court, however, observed that the magistrate hearing the case was free to call Gandhis if their presence was required.

In a major relief for the Congress leadership, the Supreme Court on Friday exempted party president Sonia Gandhi and vice president Rahul Gandhi from making personal appearance in the National Herald case.

The apex court, however, observed that the magistrate hearing the case was free to call Gandhis if their presence was required.

It further said that both Sonia and Rahul Gandhi were eminent people who would not run away, adding that it gets chaotic if prominent leaders are asked to appear before court.

The Supreme Court expunged all observations by the Delhi High Court in connection with the case.

Senior lawyer and Congress leader Abhishek Manu Singhvi told mediapersons, "Every inference and conclusion by the Delhi High Court was expunged. We had asked for no more than exemption.”

Reacting to the development, Bharatiya Janata Party (BJP) leader Subramanian Swamy refused to concede it as a relief for the Gandhis.

The Delhi High Court had earlier observed that the conduct of Congress office bearers, including Sonia and Rahul Gandhi, smacked of criminality.
