KOCHI: The Ernakulam Additional Sessions Court on Friday dismissed the bail plea of suspended Crime Branch DySP N Abdul Rasheed who is the 10th accused in the Unnithan murder attempt case.Sessions Judge P G Ajith Kumar held that, if the accused was released on bail, it will adversely affect the investigation process. Counsel submitted that Abdul Rasheed had been implicated falsely in the case and there was no reason to continue his detention. However, the court said that the contention of the petitioner that he was arrested without any ground was not true.“It is also not true that the accused was included in the case only on the basis of the confession statement of the fifth accused - Container Santhosh. There are documents to establish Rasheed’s close proximity with Container Santhosh. No responsible police officer can have such a closeness with persons having criminal antecedents,” the court said.It also said that when such a nexus was established based on materials, the confession statement could not be ignored. The CBI submitted that the petitioner feigned illness during custody, which caused much inconvenience to the investigation team. The petitioner is rich and highly influential. Besides, the investigation is now at a crucial stage and if he is released on bail, he is likely to threaten the witnesses and tamper with the evidence. When the petitioner was taken into custody, he had threatened the investigating officer saying that he would burn down his house once he is released on bail, the CBI said.“In the light of these allegations, the benefit ought to have been given to a public servant cannot be extended to Abdul Rasheed, the court said.
