BANGALORE: The state Government and the Upa Lokayukta filed their objections before the High Court on Monday in connection with the appointment of Upa Lokayukta in response to two Public Interest Litigation petitions.The petitions were filed based on an “allegedly confidential” communication. Upa Lokayukta Justice Chandrashekaraiah stated that the appointment of Upa Lokayukta had been made in strict and absolute compliance with the law under section 3 (2)(b) of the Lokayukta Act after the Chief Minister had sought the opinions of constitutional functionaries and the Chief Justice.“The CM recommended my name and tendered his advice to the Governor to appoint me as Upa Lokayukta. The consultation process by the government for appointing me was the same as was previously adopted for the appointment of all Lokayuktas and Upa Lokayukta under the Act,” he said.He stated he was not involved in the Mysore Resort scandal, and the Judicial Layout plot allotted to him at Yelahanka was supported by by-laws. A Division Bench comprising Justice N Kumar and Justice V Malimath, which heard the case, adjourned it till March 5 for further hearing.
