THIRUVANANTHAPURAM: After spending 38 days behind bars for unknown reasons, Hussain was set free on Monday after a Magistrate court here granted him bail. Hussain was arrested by the Fort police and kept under custody allegedly without allowing him to inform his family about his whereabouts. The family of Hussain, who became aware of the incident, had filed a bail application before the court, following which he was released. Thiruvananthapuram Judicial First Class Magistrate P Vishnu has also issued a show cause notice to the Sub Inspector of Fort Police Station who had made the arrest, demanding an explanation on why Hussain’s family was not informed of the arrest, as it was a blatant violation of a Supreme Court ruling which instructs the police to inform the friends or relatives of an arrested person at the earliest. It was on June 4 that Hussain, who worked at a furniture shop at Fort, was arrested while he was returning home. He was allegedly kept under custody and tortured by the police. His mobile phone and a sum of Rs 2,000 with him were also snatched by the police. Even though the family of Hussain had filed a complaint of man missing at Thumba police station, near where they lived, the police tried to cover up the incident. Following this, the family had even forwarded their grievance to the Chief Minister, Director General of Police and Human Rights Commission. Meanwhile, a senior police officer attached to the Fort Police station admitted that there had been failure on the part of the police in informing Hussain’s family of the arrest. ‘’It was because Hussain had misled the police by stating that he had no family,’’ the officer said. He also said that the department had produced before the court a report admitting to the failure and that the Sub-Inspector concerned was also facing a department-level inquiry based on the allegation raised by Hussain’s family. The Human Rights Commission has also registered a case against the City Police Commissioner in connection with the incident.
