KOCHI: The Kerala High Court on Wednesday dismissed an appeal filed by Freddy, the owner of the fishing boat involved in the firing incident, seeking an enhancement of the bank guarantee to be furnished towards the compensation claims. A Division Bench comprising Justice Thottathil B Radhakrishnan and Justice C T Ravikumar observed that the Single Judge has expressed appropriately and the order does not warrant any interference.The court had asked the owners of the merchant vessel to furnish a bank guarantee of `10 lakh against the compensation claim of Rs 72.6 lakh. Freddy submitted that after the Italian firing incident, he could not use his boat and has lost his livelihood. So, the ship owner was liable to pay the maximum compensation.Counsel for the shipping company V J Mathew submitted that the compensation claim was huge and there was no damage to the boat.
